Employers across the country are now embroiled in litigation involving 401(k) fee disclosures. If your plan doesn't disclose fee information clearly to its participants, your organization could face the same headaches!
Learn how to comply with the provisions of ERISA (Employee Retirement Income Security Act) and new rules on 401(k) fee disclosure by participating in the all-new HR Hero audio conference:
Avoiding the 401(k) Legal Trap:
How to Meet New Fee Disclosure Requirements
Bechtel, Caterpillar, Exelon, General Dynamics, International Paper, Lockheed Martin, and United Technologies are just a few of the companies accused of failing to fulfill their fiduciary duty to make certain their 401(k) plans operate with "appropriate" expenses.
And now the Department of Labor (DOL) is preparing even more fee disclosure requirements for 401(k) plans. How can HR, benefits administrators, and in-house counsel possibly stay on top of it all?
Register today for Avoiding the 401(k) Legal Trap:
How to Meet New Fee Disclosure Requirements and let an attorney experienced in ERISA litigation walk you through the complex regulations and new litigation surrounding 401(k) fee disclosures.
Here's what you'll cover in just 90 minutes:
- The general rules governing fees paid from plan assets
- The proposed regulation of revenue sharing payments
- An in-depth look at the 401(k) fee disclosure lawsuits
- An explanation of the participants' complaints
- A detailed explanation of “revenue sharing” payments
- What the courts have said about revenue sharing payments
- How to determine which fiduciaries have discretion over fees
- How to determine if revenue sharing payments are plan assets
- The standard for evaluating the “reasonableness” of fees
- How to determine if there is a duty to disclose details about fee structures
- What procedural prudence is sufficient to defeat a fiduciary breach claim
