October 30, 2008
With each CD purchase, you get FREE access to streaming audio. CD and streaming audio are available 3 days after each live event.
Even though the live seminar on this topic has already taken place, you can still hear it! For your convenience, we've recorded it on CD and audio stream, so you can listen when you have time or share it with colleagues in your organization.
In light of the House's and Senate's recent passage of the ADA Amendments Act of 2008, HR Hero is presenting a special encore audio conference, ADA Amendments Act Takes Effect Jan. 1:
Get Ready For New Challenges.
It will soon get tougher for employers to defend ADA claims...
Until recently, it was hard to establish if an employee was disabled. But the U.S. House of Representatives and the Senate just passed legislation that could bring a whole new array of ADA compliance challenges. Bush is expected to sign the ADA Amendments Act any day now, and the new legislation will become effective on January 1, 2009.
What will the new Act change for employers? What will stay the same? Learn how to comply with the new amendments by participating in this critical live event. In just 90 minutes, Jonathan R. Mook, a nationally recognized authority on the ADA, will show you how the new amendments could reverse a number of Supreme Court decisions, including:
- Sutton v. United Airlines (1999) in which the Supreme Court ruled that the ADA didn’t protect visually impaired pilots since glasses and contact lenses were “mitigating measures” that prevented the pilots from being considered disabled
- Murphy v. UPS (1999) in which the Court ruled that because a truck driver’s high blood pressure could be controlled by medication, it didn’t qualify for protection under the ADA
- Toyota v. Williams (2002) in which the Court ruled that an assembly line workers’ carpal tunnel syndrome didn’t warrant accommodation because it didn’t substantially limit major life activities
Your speaker will also cover:
- How the Act will amend the existing law and result in an expansion of those persons who may be classified as disabled
- What the amendments change regarding “mitigating measures” such as treatment that could limit protections under the old law
- Possible changes regarding the language requiring an ailment to impede a major life activity
