In December our lawmakers in Congress passed some dramatic changes to health savings accounts (HSAs) for 2007 and beyond. These new rules make it easier for employees to contribute to HSA accounts -- allowing them to make penalty-free transfers from flexible spending and health reimbursement accounts and enabling them to make one-time distributions from individual retirement plans to fund their HSAs. These exciting changes also make it easier for employers to increase their contributions to HSAs opened by lower-paid employees.

About Your Guest Speakers, John Hickman and Ashley Gillihan

John HickmanAs Partner at Alston & Bird, LLP, John Hickman is head of the Health & Welfare Benefits sub-group of the firm's Employee Benefits and Executive Compensation Group, as well as the firm's Privacy and Data Management Task Force. He concentrates his practice primarily on health and welfare benefit plan matters, and the tax, ERISA, HIPPA, and other compliance issues that arise in connection with such arrangements. Additionally, he is an adjunct professor of law at Emory University School of Law.
Mr. Hickman represents employers, insurers, and third-party administrators, assisting them with plan design and limiting their potential exposure to benefit claims. He has been called upon by benefits and trade associations to testify before the IRS and DOL on issues affecting health and welfare benefit plans including HIPAA, cafeteria plan regulations, DOL claims procedures, and the recent DHHS health care privacy regulations.
Mr. Hickman has lectured widely and published articles on HIPAA, ERISA litigation, and cafeteria and health plan issues. He is co-author of the 'Cafeteria Plans Manual,' 'HIPAA Portability and Privacy,' and 'Consumer-Driven Health Care & Fringe Benefits' (published by the Employee Benefits Institute of America). He is also on the editorial advisory board of the Benefits & Compensation Law Alert, is a past member of the editorial advisory board of the 'Benefits Law Journal,' is Chair of the Technical Advisory Committee of the Employers Council on Flexible Compensation (ECFC), and is on the Publications Committee of the Self-Insurance Institute of America.

Al GillihanAshley Gillihan is a partner in the Firm's Employee Benefits and Executive Compensation Group. He is also a secondary member of the firm’s ERISA Litigation Group, and focuses his practice exclusively on assisting clients with various health and welfare benefit plan issues, including ERISA rules and requirements, tax issues, health plan mandates, welfare benefit plan issues, COBRA administration, HIPPA issues and other related issues.
Mr. Gillihan represents corporate plan sponsors, insurers, and financial institutions involved in consumer driven health care (e.g. card processors, banks), and third party benefit plan administrators. He lectures frequently and has published numerous articles on health and welfare benefit plan related topics. He is a contributing author for the 'Flexible Benefits Answer Book,' published by Aspen Publishers. He is also a faculty member for MCOL and the Institute of Applied Management and Law (IAML). He is also a member of the Advisory Board of Editors of the 'Benefits Compensation Law Alert' and the Employer’s Council on Flexible Compensation Technical Advisory Council.
