Dana Rust, a partner at the McGuireWoods law firm in Richmond, Virginia, has represented employers before the U.S. Occupational Safety and Health Administration, the U.S. Mine Safety and Health Administration, and state OSHA agencies. He has tried cases before OSHA and MSHA administrative law judges. His expertise includes working with manufacturing and construction companies, and he has represented employers in several cases involving workplace fatalities. He also regularly counsels employers in all aspects of the employment relationship and in drafting of policies and procedures. He tried the first OSHA whistleblower case brought by the Virginia Department of Labor and Industry.
Mr. Rust regularly counsels employers in all aspects of the employment relationship including layoffs, plant closings, the discipline and termination of union and nonunion employees, compliance with Title VII, the ADA, the FMLA, the WARN Act and the handling of OSHA and MSHA inspections. He also regularly assists employers in the drafting of policies and procedures, noncompete, employment and separation agreements.
David Fortney is a co-founder of Fortney & Scott, LLC. In his practice, Mr. Fortney counsels clients on the full spectrum of work-place related matters, including employment discrimination and labor matters, compliance programs, government contracting, and developing strategies for avoiding or responding to workplace-related crises. He is co-editor of the monthly newsletter Federal Employment Law Insider.
Mr. Fortney formerly served as the Acting Solicitor of Labor and held other senior policy positions in the U.S. Department of Labor during the Administration of George H.W. Bush. His practice continues to involve the federal agencies regulating the workplace. He recently served on the Presidential Task Force on the 21st Century Workplace and testified before Congress and a state legislative committee on the overtime regulations.
Mr. Fortney has been widely recognized for his professional accomplishments, including being named one of the leading employment lawyers in Washington, D.C. by the CHAMBERS USA survey of "America’s Leading Lawyers for Business" in 2009, 2008, 2007, 2006 and 2005.
