HR Hero Audio Conference on CD and Streaming Audio
Presented by John B. Phillips, Jr
February 12, 2008
With each CD purchase, you get FREE access to streaming audio. CD and streaming audio are available 3 days after each live event.
Even though the live seminar on this topic has already taken place, you can still hear it! For your convenience, we've recorded it on CD and audio stream, so you can listen when you have time or share it with colleagues in your organization.
Employer beware! It may seem like a great way to control labor costs. But just calling someone an independent contractor won't cut it. Even a signed and sealed written agreement outlining the arrangement may not be enough.
The Internal Revenue Service just ordered FedEx to pay $319 million in back taxes and fines for misclassifying "independent contractors" at their ground delivery business in 2004. The company may have to shell out even more fines and back taxes as the IRS continues to audit the employment status of contractors used between 2004 and 2006. And New York's Governor Spitzer just signed an order that will force employers to pay fraud penalties and face higher tax assessments for workers who are misclassified. Other states may soon follow.
Help your organization avoid devastating fines and penalties by learning how to properly classify each and every employee and contractor. Participate in the all-new audio conference, Misclassification Myths: Are Your Workers Really Independent Contractors? and nationally recognized employment law attorney John B. Phillips, Jr. will show you how to separate fact from fiction when it comes to:
- Determining if someone is an independent contractor, statutory employee, statutory nonemployee, or common-law employee
- What the Internal Revenue Service and other agencies look for when determining if a worker is an employee or a contractor (The IRS has a comprehensive list of questions and wage & hour officials have an entirely different test method.)
- The consequences of improperly treating an employee as a contractor: Employers can be found liable for back taxes, as well as minimum wage, overtime, and benefits violations — and if one agency finds a violation, it can notify other agencies.
- How you should distinguish temporary workers from independent contractors
- Debunking the myths behind appropriate and inappropriate use of contractors
- Using written contracts to stipulate that a worker is an independent contractor — and whether any such contract is worth the paper it's written on
