Harassment lawsuits continue to be a major risk for all employers. And it isn't just sexual and racial harassment -- many claims are based on religion, national origin, age, and disability.

Just about everyone who claims harassment also claims that a supervisor or co-worker used language that is inappropriate, hostile, sexist, racist, ethnically charged, crude, gross, insensitive, age-based, or derogatory. So, do supervisors have to be the language police? What if the language is between two people of the same gender? Same race? Same ethnicity? What if only one person is offended? How many dirty jokes can you get away with before it becomes harassment? Can cursing constitute harassment? Your supervisors learn the answers to these critical questions.
(5) Preparing for Personal Liability
In matters of harassment, your company will be sued, but so will the supervisor. Will the supervisor need to hire a personal lawyer? If you're in HR and you know about harassment and did nothing about it, you may be sued, too, even though you weren't the harasser and the employee allegedly being harassed didn't report to you.
(6) Executing Investigations
Properly done harassment investigations are essential to limiting your liability and exposure to huge jury awards. Should supervisors investigate harassment claims? What if the supervisor is the target of the investigation? At what point should legal counsel be involved? Can the supervisor continue to oversee the complaining employee? Once the investigation is complete, what's next?
