- 12-week qualifying exigency leave for non-medical reasons, for an employee who has a spouse, parent, or child called to active duty from the National Guard or reserves; and
- 26-week military caregiver leave for an employee who is the spouse, parent, child, or next of kin of a service member in the armed forces who is receiving treatment for a serious illness or injury incurred while on active duty.

David S. Fortney served as the Acting Solicitor of Labor and held other senior policy positions in the U.S. Department of Labor. His practice continues to involve the federal agencies regulating the workplace. He recently served on the Presidential Task Force on the 21st Century Workplace and testified before Congress and a state legislative committee on the overtime regulations.
Co-founder of Fortney & Scott, LLC, Mr. Fortney counsels clients on the full spectrum of work-place related matters, including employment discrimination and labor matters, compliance programs, government contracting, executive employment and compensation, international dispute resolution and counseling matters, and developing strategies for avoiding or responding to workplace-related crises. He is co-editor of the monthly Federal Employment Law Insider.

She served as the Counsel for International Affairs/Opinions at DOL in the George H.W. Bush and Bill Clinton administrations. As principal DOL drafter for USERRA, she coordinated and led the Executive Branch interagency task force and worked with the White House and Congress prior to its enactment.
