Has your organization implemented a wellness program to control escalating medical costs? You're not alone. The number of large U.S. employers using wellness programs jumped from 62% to 72% in 2008, according to a recent ERISA Industry Committee and the National Association of Manufacturers study. And two-thirds (66%) of U.S. employees are taking steps to improve personal care through the use of workplace wellness programs and other initiatives, according to a Watson Wyatt survey.

But many wellness programs run the risk of violating HIPAA, ADA, ERISA, COBRA, and other federal and state laws. Learn how to keep your workplace wellness programs from incurring expensive litigation by participating in the all-new HR Hero audio conference, Employee Wellness Programs: How to Minimize Your Legal Risks.

In just 90 minutes, an attorney experienced in health and welfare benefit plan issues will answer such questions as:

  • Under what circumstances can employers provide wellness incentives without violating HIPAA’s nondiscrimination rules?
  • When does HIPAA privacy apply and how does it impact an employer’s ability to collect and process information?
  • Does an employer have to offer COBRA continuation of wellness programs? If so, what are the "coverage" requirements?
  • What about ADA’s impact on designing wellness programs? Are there certain diseases or conditions that employers can or cannot target? What impact do the recently enacted ADA amendments have on wellness programs?
  • What, if any, impact does the ADA have on health risk assessments?
  • Is an employer’s wellness program subject to ERISA? and, if so, what does that mean for a company’s ERISA compliance policies?
  • What about tax issues? Are all programs excluded from income? Are all wellness incentives?
  • Are state laws an issue? How do states’ smoker protection laws impact wellness programs?

Employee Wellness Programs: How to Minimize Your Legal Risks is just $237.
